A. Agency Relationship & Third-Party Providers

    • Navari acts solely as an agent/coordinator 
    • Does not own, operate, or control airlines, hotels, transport companies, venues, or other suppliers 
    • All vendors are independent contractors, not partners, employees, or agents of Navari 
    • Navari is not responsible for acts, omissions, delays, failures, negligence, or insolvency of any third-party provider 

B. Scope of Services / No Fiduciary Duty

    • Services are limited to planning, coordination, and booking assistance only 
    • No fiduciary, legal, financial, tax, medical, or security advice provided 

C. Acceptance of Supplier Terms

    • Client agrees they are also bound by each supplier’s individual terms and conditions 
    • Supplier rules regarding cancellation, refunds, changes, and penalties apply 

D. Non-Transferability of Bookings

    • Bookings not transferable without supplier approval 

E. Force Majeure / Events Beyond Control

    • Navari not liable for delays, cancellations, losses, or damages caused by: 
    • weather 
    • war or terrorism 
    • civil unrest 
    • government actions or sanctions 
    • border closures or visa policy changes 
    • natural disasters 
    • strikes or labor actions 
    • public health emergencies or pandemics 
    • security incidents 
    • Such events constitute force majeure and do not create liability for Navari 

F. Traveler Responsibilities

    • Client solely responsible for: 
    • passports 
    • visas 
    • vaccinations 
    • health requirements 
    • customs and entry rules 
    • Failure to meet requirements is client’s responsibility and may result in denied boarding or entry 

G. Accuracy of Client Information

    • Client responsible for accuracy of all information provided 
    • Navari not liable for losses due to incorrect or incomplete client data 

H. Pricing, Currency, Taxes & Fees

    • All prices subject to change until fully paid and confirmed 
    • Currency fluctuations may affect final cost 
    • Additional taxes, resort fees, service charges, or government fees may apply 

I. No Guarantee of Availability or Outcomes

No guarantee of: 

    • reservations 
    • seating 
    • upgrades 
    • access to events 
    • specific rooms, aircraft, or experiences 
    • Availability and pricing controlled by suppliers 

J. Itinerary Changes & Substitutions

Schedules, routes, accommodations, and services may change

    • Navari not liable for: 
    • equipment substitutions 
    • time changes 
    • rerouting 
    • supplier cancellations 

K. Accessibility & Special Needs

Client responsible for disclosing:
 

    • medical needs 
    • mobility limitations 
    • dietary restrictions 
    • service requirements 
    • Navari not responsible if suppliers fail to accommodate special needs 

L. Limitation of Liability (Cap on Damages)

    • If liability is found, damages limited to fees paid to Navari for services only. 
    • Travel costs and supplier charges excluded from liability. 

M. Indemnification by Client

Client agrees to defend and indemnify Navari for claims arising from:
 

    • client conduct 
    • violations of law 
    • damage to property 
    • disputes with vendors caused by client actions 


N. Chargebacks & Payment Disputes

Chargebacks after services are rendered constitute breach of contract 

Client responsible for: 

    • supplier penalties 
    • administrative fees 
    • chargeback costs 

O. Payment Authorization & Fraud Protection

    • Client authorizes approved charges to payment method 
    • Client represents they are authorized cardholder 
    • Fraudulent disputes void contractual protections 

P. Governing Law, Venue & Dispute Resolution

    • Florida law governs all disputes 
    • Venue limited to specified Florida county (Although I personally reside in Colorado, the business is registered and regulated in Florida (Seller of Travel). I want Florida law to govern and venue to be exclusively in the Florida county associated with the business’s Florida registration or principal place of business, not my registered agent and not Colorado.) 
    • Claims must be brought individually, not as class actions
